No FEC Decision on NRLC Ads

The Federal Election Commission (FEC) could not reach an agreement on either draft regarding two proposed radio ads sponsored by the National Right to Life Committee Inc. (NRLC) and whether or not they contained "express advocacy". The alternative ruling drafted by FEC Chairman Donald McGahn, which stated that both NRLC ads could air without funding restrictions failed on a 3-3 party-line vote.

AU Asks IRS to Investigate New Jersey Catholic Diocese and New Mexico Church for Partisan Electioneering

Americans United for Separation of Church and State has asked the IRS to investigate the Roman Catholic Diocese of Paterson, N.J. and Rock Christian Fellowship in Espanola, New Mexico. According to AU's letter to the IRS, Roman Catholic Bishop Arthur J. Serratelli has published a letter on Catholic Diocese of Paterson, N.J.'s website and newspaper attacking Barack Obama." The letter criticizes Obama for his pro-choice stance and encourages parishioners not to vote for Obama.

Groups Challenge Constitutionality of New Telecom Immunity Law

The Electronic Frontier Foundation (EFF) has challenged the constitutionality of the Foreign Intelligence Surveillance Act Amendments of 2008, which grants telecommunication companies retroactive immunity for helping with the government's warrantless surveillance program. EFF argues that the FISA Amendments Act violates the federal government's separation of powers as established in the Constitution. The challenge also says the law deprives telecom customers of their rights without due process of law.

FEC Issues Draft for Ads, Slight Differences as to What Constitutes Electioneering

The Federal Election Commission (FEC) issued a draft advisory opinion (AO 2008-15) with a ruling on radio ads sponsored by the National Right to Life Committee (NRLC). NRLC sought out how the FEC would view the ads under the FEC's "electioneering communications" rules. The FEC draft deals with two, nearly identical ads. Both NRLC ads end by calling on Obama to apologize; "Will Obama now apologize for calling us liars when we were the ones telling the truth?" The second commercial then adds a last line saying, "Barack Obama: a candidate whose word you can't believe in."

Americans United Files IRS Complaint Against Arkansas Church

Americans United for Separation of Church and State filed an IRS complaint against Word Outreach Christian Center in Little Rock, Ark. AU alleges that Bishop Robert Smith endorsed John McCain and Sarah Palin in an Oct. 12 Sermon. Smith's sermon was part of the Sept. 28 "Pulpit Freedom Sunday" initiative organized by the Alliance Defense Fund. Smith was unable to deliver his sermon on that date, so he postponed it until Oct. 12. Smith's church is the eighth church that AU has asked the IRS to investigate as a result of "Pulpit Freedom Sunday."

Newly Released Legal Memo; Religious Hiring Doesn't Prevent Taxpayer Funding

The Washington Post reports that the Justice Department Office of Legal Counsel issued a legal opinion allowing the Justice Department to distribute a $1.5 million grant to World Vision, a Christian aid group that makes religious belief a condition of employment. More so, the legal opinion sheds light on the office that interprets laws across the government. "Much of the work of the office remains secret.

OMB Watch Comments Opposing Expanded Gov't Investigation Powers Under Safe Streets Act

On Sept. 2, 2008 OMB Watch filed comments on the Department of Justice (DOJ) proposed amendments to 28 C.F.R. 23, which governs programs that receive funding under the Omnibus Crime Control and Safe Streets Act of 1968 (Safe Streets Act). We asked DOJ to reject the addition of "domestic and international terrorism, including material support thereof" to the list of activities that could be investigated. Our comments noted, "This is redundant, since terrorism and providing material support for it are crimes, and the current rule already covers criminal activity.
