Comments Filed on Proposed Charitable Choice Rules for Veterans Administration

On Oct. 30, OMB Watch filed comments on proposed rules for religious organizations that receive grants under the Homeless Providers Grant and Per Diem Program administered by the Department of Veterans Affairs. The comments object to rule changes that would allow religious discrimination in hiring for federally funded positions and permit religious content in service programs. Help to Develop National Guidelines for the DUNS Number Requirement

The federal government is now requiring applicants for federal funding to have a DUNS number from Dun and Bradstreet. A new toll-free number to call and have a DUNS number assigned to organizations was announced last week- 1-866-705-5711. Remember: You do NOT have to purchase credit services from Dun and Bradstreet to get a DUNS number. If they try to sell you these services, please let us know.

Workforce Investment Act Passes through Senate Committee Without Religious Discrimination Provision

Senate Committee ignores the House's version of the Workforce Investment Act and passes its own version. The House’s Workforce Reinvestment and Adult Education Act gives approval to faith-based charities to discriminate based on religious affiliation when hiring staff for federal job training programs. The bill, H.R. 1261 removes Title VII language of the Civil Rights Act to allow religious discrimination in hiring for federal job-training programs. If H.R. 1261 becomes law it will be an unprecedented repeal of civil rights laws.

Six Agencies Act on Faith-Based Regulations

In late September the Bush administration announced final regulations implementing faith-based grant rules that Congress could not even pass. For example, the rules place the burden of objecting to the religious nature of a service provider on the person in need, who must ask for an alternative provider. The regulations do not clearly define "inherently religious" activities that cannot be paid for with federal funds in grant programs. However, services paid for with vouchers or certificates can contain religious content.

Compassion Capital Fund Sub-Grant Policy Challenged

A grant announcement for the Compassion Capital Fund (CCF) Demonstration Program has been challenged by Americans United for Separation of Church and State (AU) because it instructs intermediary organizations not to consider the religious nature of programs in selecting sub-grantees. AU sent a letter to Clarence Carter, Director of the Office of Community Services at the Department of Health and Human Services (HHS), explaining its objections and asking for a response by September 18. It said the policy might lead to unconstitutional federal support of religious content in programs.

OMB Asks for Comments on Proposed Changes to Audit Form

Nonprofits that get federal grants have an opportunity to suggest ways audit forms can be streamlined for reports auditors make to them and reports grantees must submit to the federal government. A Federal Register notice invites comments on changes proposed for current audit forms, including the SF-SAC and single audit reporting packages. Comments are due on or before October 14.
