ACLU Report Calls for Oversight, Overhaul of Patriot Act

Reclaiming Patriotism: A Call to Reconsider the Patriot Act was published by the ACLU on March 11, 2009. It urges Congress and the public to take advantage of the opportunity created by the expiration of three surveillance provisions in December 2009 to "thoroughly evaluate all Patriot Act authorities –as well as any other post 9/11 domestic intelligence programs – and to rescind, repeal or modify provisions that are unused, ineffective or prone to abuse." The report cites surveillance programs and the overbroad definition of material support of terrorism, which inhibits legitimate charitable work, as primary provisions for review and revision. It also makes specific recommendations for reform.

Report: Afghanistan: Humanitarianism Under Threat

As the Obama administration heightens military and humanitarian operations in Afghanistan, a new briefing paper links the success of national reconstruction to maintaining a demonstrable separation between humanitarian groups and the military. Presenting information collected over several years, Afghanistan: Humanitarianism Under Threat, written by Antonio Donini of the Feinstein International Center at Tufts University, calls for swift action to prevent the misperceptions of local populations that result in violence toward aid workers and volunteers who are working for their benefit.

Effective Date for PVS Delayed One Month

USAID's controversial Partner Vetting System's (PVS) effective date has been delayed until May 4, 2009.  The Federal Register announced the delay a day before the original deadline on April 3.  The final outcome for PVS remains undecided, but critics still warn that PVS is incomplete, unnecessary and dangerous.

On March 18, 2009 the House Foreign Affairs Committee held its third hearing in an ongoing investigation into the proper role of the military in the government's foreign assistance efforts.  Committee Chair Howard L. Appointments for Top Treasury Posts: Will They Take a Big Picture View of Charities and Security?

On March 23 the Obama administration announced appointment of three top Treasury officials: Neal Wolin as Deputy Secretary, Lael Brainard as undersecretary for international affairs, and Stuart Levey to continue as undersecretary for terrorism and financial intelligence. Appeals Court Says Charity's Challenge to Warrantless Wiretapping Can Proceed

The only remaining case challenging warrantless wiretapping during the Bush administration, Al-Haramain v. Bush, has survived another attempt by the Department of Justice (DOJ) to have it dismissed because it claims key evidence cannot be used without threatening national security. Cohen Nominated as Assistant Treasury Secretary of Terrorist Financing

Nominated for Assistant Treasury Secretary of terrorist financing, David S. Cohen is experienced in complex civil litigation, white collar criminal defense, internal investigations and anti-money laundering counseling. Cohen served concurrently as Acting Deputy General Counsel and Associate Deputy General Counsel of the US Department of the Treasury during the Bill Clinton administration. If confirmed by the Senate, Cohen will be at the center of steering policy of terrorist financing related issues.  It remains unclear how his nomination will impact the decisions of Under Secretary of the Treasury for Terrorism and Financial Intelligence, Stuart Levey, who appears unlikely to be removed from his position in the near future.

UK Charity Commission: Interpal Not Supporting Terror Groups

A Feb. 27, 2009 report by the United Kingdom's Charity Commission into the activities of Palestinians Relief and Development Fund (Interpal) concluded the charity is not funding or supporting groups sponsoring terrorism. The Commission ordered improvements in procedures for choosing and overseeing local charity partners in the Occupied Palestinian Territories, Jordan and Lebanon. It also recognized the importance of charities that conduct aid related activities in "high-risk" areas of the world and acknowledged the dangers they face.
