Up-to-date Freedom of Information Act (FOIA) rules that support transparency are important for ensuring agencies are properly implementing the law. Last week, the Center for Effective Government submitted comments to the Institute of Museum and Library Services (IMLS) on its proposed FOIA implementation regulations and encouraged the agency to expand online disclosures, improve communication with requesters, clarify fees and fee waivers, and improve the process of submitting and processing administrative appeals.
Recent reflections of a former executive agency official illustrate the troubling role the White House Office of Information and Regulatory Affairs (OIRA) plays in reviewing all agency rules before they can be issued. In a new article, Lisa Heinzerling shares her perspective on OIRA review during her tenure at the U.S. Environmental Protection Agency (EPA). Notably, Heinzerling gives a first-hand account of how the White House interacts with agencies regarding rules, contradicting the story being told by former OIRA Administrator Cass Sunstein and challenging the unrecognizably rosy picture of rule reviews he spins. Indeed, Heinzerling identifies a number of problems with OIRA, including significant delays and a lack of transparency, that resonate with health and safety advocates.
On May 16, the U.S. Department of the Interior's Bureau of Land Management (BLM) released a revised proposed rule for hydraulic fracturing on federal public lands (commonly referred to as fracking). The new proposed rule not only ignores concerns about the public health and environmental risks of the natural gas drilling method, it also disregards recommendations by lawmakers and the U.S. Department of Energy's Shale Gas Production Subcommittee, which called for transparency and full public chemical disclosure. The proposed rule suggests the agency has placed industry concerns ahead of public health and safety. It also contradicts the new data standards the Obama administration issued just last week by executive order.

The U.S. Chemical Safety Board (CSB) released a new video this month that starkly illustrates the devastation caused by the West Fertilizer Company plant explosion in West, TX, on April 17, 2013.
In the video, Daniel Horowitz, Managing Director of the CSB, notes, "The community damage we saw at West was the worst of any chemical accident in the CSB's history."
On May 7, Sen. Richard Blumenthal (D-CT) sent a letter to the White House Office of Management and Budget (OMB) urging the agency to end excessive delays in reviewing crucial health and safety protections. Echoing the concerns of public interest and safety advocates, Blumenthal wrote "that there are human costs to delay" and asked newly appointed OMB Director Sylvia Mathews Burwell to immediately complete reviews of several proposed agency actions.
In April, the Office of Management and Budget (OMB) released a draft report on the benefits and costs of federal standards and safeguards. The report shows that over the past 10 years, public protections have produced vast benefits at minimal cost. In all, the estimated annual benefits of these rules ranged from $192.7 billion to $799.7 billion, while costs ranged from $56.6 billion to $83.7 billion.
Anhydrous ammonia and ammonium nitrate are the two substances that have been investigated as possible causes of the April 17 explosion of the West Fertilizer Company plant in Texas. Though experts now believe the explosion was due to the ammonium nitrate, the facility did have two 12,000-gallon tanks of anhydrous ammonia, which could have exacerbated the tragedy in Texas had they leaked or exploded.
Community members living near an army ammunition plant traveled to Washington, DC, on Monday to deliver petitions to their senators and representatives calling for groundwater testing near the plant. The work of local residents demonstrates the importance of citizen action and environmental data in protecting public health.
