Comments on Form LD-203

The Alliance for Justice issued comments to the House and Senate in response to a request for comments concerning Form LD-203, used by lobbying entities and individual lobbyist to report certain contributions under section 203(a) of the Honest Leadership and Open Government Act of 2007 (HLOGA). The comments reference the revised Lobby Disclosure Act (LDA) guidance issued July 16, 2008.
The examples in the LDA Guidance do not address the very common situation in which an event has multiple purposes, only one of which is to honor a covered official. A charitable organization may, for example, sponsor an annual fundraising event. During the course of the event, there may be a featured speaker on a topic of interest to the attendees, who is not a covered official, one or more honorees who are not covered officials, and one or more honorees who are covered officials. [. . .] We do not believe that under these circumstances lobbying entities and lobbyists should be required to report on the event at all, since the sole or primary purpose of the event is not to honor the covered official.
