Hearing Cancelled on "Leaks" Criminalization Provision of Intelligence Authorization Act

In the early evening of September 4th, Senate Select Committee on Intelligence Chairman Robert Graham announced cancellation of the hearing on a provision planned for inclusion in the 2002 Intelligence Authorization Act that would have made a felony of any unauthorized disclosure of any classified information by any current or former federal employee. The hearing had been scheduled for the following afternoon. At the same time, Senator Graham stated that the provision would not be included in the Intelligence Authorization Act. This turn of events is attributable to both the lack of Administration support for the provision and their ability to finally convince Senators Shelby (the provision's sponsor) and Graham of that lack of support and to the huge lobbying effort of a coalition that includes many public interest groups and media organizations. The mark-up of the bill on September 6th does include language requiring the Attorney General to report by May 1, 2002 on need for legislation and actions to be taken. In the interim, the Administration has indicated that a dialogue will take place with some of the publishing community to further explore the nature and extent of a leaks problem and the appropriate responses.
