Real Truth About Obama Again Denied Request for Preliminary Injunction

In a case from the 2008 campaign, the Real Truth About Obama (RTAO) lost its bid for a preliminary injunction. RTAO is a 527 organization that wanted to run ads examining then presidential candidate Barack Obama's position on abortion and other policy issues. The group argued it was not a political action committee (PAC) and filed a lawsuit to prevent the enforcement of several Federal Election Commission (FEC) regulations regarding when a group must register as a PAC, as well as the enforcement of reporting requirements for political organizations.

This decision upholds a federal district court ruling from Sept. 2008 which rejected their challenges, and denied RTAO's request for a preliminary injunction. The court found that RTAO did not demonstrate "that it is likely to succeed at trial on the merits." The case will now return to the federal district court.
