More 3-3 Votes at the FEC

The Federal Election Commission (FEC) continues to "find no reason to believe that respondents violated the Act." More cases have been closed by the FEC with tied votes by the commissioners. American Rights at Work filed a complaint charging that Wal-Mart stores used corporate resources to advocate for the defeat of democrat candidates. Information on the case is available from the FEC, MURs 6501-6052. As the Political GPS blog points out, the FEC "has become the place where complaints go to die."
Another case was dismissed regarding a complaint alleging that four 527s, Patriot Majority, Patriot Majority West, Patriot Majority Midwest, and Patriot Majority New Mexico, all failed to register as political committees and failed to disclose reports with the FEC. The Factual and Legal Analysis states: "The advertisements focus on the federal candidate's record or position on an issue without reference to character or fitness for office and end with asking the viewer or listener to contact the candidate at the telephone numbers provided and tell him or her to stop taking a specific action."
The FEC rejected another case which also accused a group of failing to register as a political committee. The Minnesota Democratic-Farm-Labor Party charged that the American Future Fund aired television ads that advocated for the re-election of Sen. Norm Coleman. The FEC did not find that the group engaged in express advocacy.
And finally, last year the Council on Islamic American Relations filed a complaint against the Clarion Fund, Inc. for making improper contributions to the 2008 presidential campaign by distributing a movie in swing states called "Obsession: Islam's Radical War Against the West." The FEC found the DVD did not identify a candidate, and found no evidence it was distributed in connection with the presidential race.
