Draft IRS Form 990 Aims for Greater Transparency

The New York Times reports on some of the initial reactions to the 990 changes. According to IRS Exempt Organizations Director Lois Lerner, the redesign of Form 990 is "the biggest thing the exempt organizations division at IRS has done in the last quarter century." The form has not been overhauled since 1979. Lerner said the new draft will be easier for most charities to fill out and provide more information. However, some may be doubtful, and expect the lengthened draft to be criticized as being burdensome.

Alert: Redesigned Form 990 Released

The IRS released for comment and discussion proposed revisions to Form 990 and other supporting information. The IRS hopes to have the form ready for use for the 2008 filing year for returns filed in 2009. The redesign is based on three principles, "enhancing transparency, promoting tax compliance, and minimizing the burden on the filing organization." The comment period will run for 90 days, and comments are due no later than September 14, 2007.

Davenport v. Washington Education Association, A Forecast for WRTL?

The U.S. Supreme Court ruled that states can require public employee labor unions to get consent from non-members before using their dues for political activities and lobbying. Justice Antonin Scalia said the law does not violate the union's First Amendment rights. Now, many are eager to use this ruling to make predictions for the outcome of the Wisconsin Right to Life (WRTL) case which will be decided by the end of the month. Von Spakovsky Grilled on Role at Justice

The politicization of the Department of Justice (DOJ) has seeped into the confirmation of FEC Commissioner Hans von Spakovsky. Yesterday's hearing proved to be divisive. Von Spakovsky's questioning focused on his former position as a lawyer in the Voting Rights Section of DOJ's Civil Rights Division from 2001 through 2005. Particularly Senators Dianne Feinstein (D-CA) and Richard Durbin's (D-IL) questioning suggested that his work at the DOJ disqualifies him from serving a full term at the FEC.

Lawsuit Settled Challenging Government Funding of Faith-Based Job Training Program

The state of Pennsylvania and civil liberties groups settled a lawsuit that challenged government funding of a faith-based job training program at a county jail. The settlement requires that state officials do not use public funds to support religious activities, that tax-funded programs will not religiously discriminate against program participants, and that the state will monitor the program activities to ensure there are no violations.

In late May, news surfaced of an Internal Revenue Service (IRS) inquiry into a Wichita, KS, church, Spirit One Christian Center. Another new complaint, against Bill Keller Ministries, also was made public. Both cases involve statements about candidates that are alleged to indicate opposition to their election.
