State Secrets Protection Act Passes House Subcommittee on Constitution Civil Rights and Civil Liberties

Update: "Right-wing" Report Still Accumulating Critics and Supporters

A controversial DHS report that warned of "right-wing extremism" refuses to surrender its place in the public spotlight. Immediately condemned by veterans' groups and Republican lawmakers after its release in April 2009, the report is now being heralded by some as a timely warning in the wake of several acts of domestic violence that attracted national attention. The initial criticism of the report led to its withdrawal and triggered a House resolution exploring its creation.

Report: Red Cross Task Force Defines "Direct Participation in Hostilities" and Protected Civilian Status

As warfare moves away from the battlefield and armed forces of nation-states and is often conducted in densely populated cities and regions by organized armed groups, including terrorist organizations, the line between combatants and civilians has become increasingly blurred. To address the pertinent distinction, the International Committee of the Red Cross (ICRC) released Interpretive Guidance on June 2, 2009 that clarifies the meaning of "direct participation in hostilities."

ABA Also Recommends Guidance on Political Activity for Tax-Exempt Groups

The American Bar Association (ABA) Section of Taxation submitted recommendations for inclusion in the 2009-2010 Treasury Department and Internal Revenue Service (IRS) guidance priority list. Their recommendations included multiple items for nonprofit organizations.

Obama's Cairo Pledge on Charitable Giving Rules Opens Door to Reform

President Obama's June 4 speech in Cairo had encouraging words for nonprofit organizations in the U.S. and around the world, as he recognized that U.S. charitable giving rules have made charitable donations difficult for Muslims and committed himself to working with American Muslims to resolve the problem. The Charity Security Network and Muslim Advocates each responded with statements pledging cooperation in developing new rules that protect and promote legitimate charitable programs and their donors, both Muslim and non-Muslim.

Senate Rules Committee Approves FEC Nominee

On June 11 the Senate Rules and Administration Committee approved President Obama's nomination of John Sullivan for a Democratic seat of the Federal Election Commission (FEC). Sullivan's nomination now goes to the Senate floor for a confirmation vote. Sullivan has been a lawyer at the Service Employees International Union (SEIU) since 1997.

AU Asks IRS to Investigate Virginia Church

Americans United for Separation of Church and State (AU) asked the Internal Revenue Service (IRS) to investigate Fifth Street Baptist Church in Richmond, Virginia for engaging in prohibited electioneering. The tax code prohibits certain organizations, including charities and churches, from intervening in any political campaign on behalf of, or in opposition to, any candidate for public office.

Groups Call on Senators to Support S.482

OMB Watch signed on to a letter sent to every Senator asking them to support S. 482, the Senate Campaign Disclosure Parity Act and oppose any amendment to the bill. S482 would require Senate candidates and committees to file their campaign finance reports electronically, as House candidates, presidential candidates and other political committees already do.

USA Today reports that regardless of the gift ban under the Honest Leadership and Open Government Act (HLOGA), signed into law in 2007, lobbyists continue to spend a vast amount of money to honor members of Congress or donate to nonprofits connected to them. The law requires lobbyists and entities that employ lobbyists to report payments to events or groups associated with legislators or top federal officials.
