LA Times Brings to Light Voter Identification Attempts

As primary elections are taking place today in nine states including the District of Columbia, voters should pay heed to the various voter identification efforts throughout the country. The LA Times today put out a very helpful and comprehensive story on these cases. The dispute, which is being fought in disparate and often half-empty courtrooms in as many as nine states, concerns new state laws and rules backed primarily by Republicans that require people to show photo identification in order to vote and, in some cases, proof of citizenship and identification when registering to vote.

Nonprofits Mobilize to Fight Voter Suppression

A growing body of state laws and regulations governing voter registration and the voting process create barriers to voting that discriminate against minorities, new citizens and the elderly. Nonprofits are challenging these new voter suppression tactics, including filing several lawsuits. These voter drives build off efforts that support election reform programs mandated by the Help America Vote Act of 2002, and these developments illustrate just how important nonprofit organizations are as vehicles of civic participation.

FEC Deadlocks on Grassroots Lobbying Broadcast Exemption

On Aug. 29 the Federal Election Commission (FEC) voted down a proposed interim rule that would have exempted grassroots lobbying broadcasts from a federal rule banning ads that mention an incumbent before an election. The vote on the grassroots exemption failed on a 3-3 party-line vote, with Democrats rejecting all proposals.

Recently enacted state laws, one proposed regulation and a bill in Congress have united some nonprofits in an effort to curb government sponsored voter discrimination and suppression. Challenges brought by nonprofits have resulted in court victories, and decisions on proposed regulations are pending. These battles are being waged in a pivotal election year, amidst a backdrop of national efforts to curb voting registration, and a recent effort by some members of Congress to limit the reach of the landmark Voting Rights Act Reauthorization. IRS Drops Case Against NAACP

On Aug. 31 the National Association for the Advancement of Colored People (NAACP) announced that, after an investigation lasting nearly two years, the Internal Revenue Service (IRS) found the group did not violate the ban on partisan electioneering in 2004. The group will thus retain its tax-exempt status. The case raised questions about the right of charities and religious organizations to criticize elected officials' policies, the role of partisan politics in IRS investigations, and the legality of the new IRS enforcement program.

House Judiciary Favors Religious Compliance

CQ reported that HR 2679, the Public Expression of Religion Act of 2005 was approved on September 7th by the House Judiciary Committee. The bill makes suing a government official over public expression of religion very difficult, in that plaintiffs will be responsible for financial damages, costs or lawyer’s fees. Islamic Charity Allowed to Proceed With Lawsuit

Yesterday a federal judge in Oregon ruled that national security would not be threatened with the advancement of a lawsuit that challenges the well known Terrorist Surveillance Program. Al-Haramain Islamic Foundation, a charity based in Oregon that distributed religious literature to prison inmates, filed a lawsuit in February claiming that the National Security Administration listened to telephone conversations in 2004 between the group's director in Saudi Arabia and his U.S. lawyers. Transparency Bill on Federal Grants, Contracts and Spending Passes Senate

After a full month of secret holds and back-room manuevering, of personal conflicts and idle rhetoric, a bill promoting transparency and disclosure of a vast array of government spending has finally passed one chamber of Congress. Late last night, during a period when all previous secret holds on the bill had been removed, Majority Leader Bill Frist (R-TN) acted quickly and S. 2590 was quickly approved unanimously by the Senate.

Phone Forum on Election Involvement by 501(c)(3) Organizations

With the 2006 election just around the corner, the IRS has scheduled two free conference calls for tax exempt organizations on September 19th and 20th to discuss the electoral activity of 501(c)(3) organizations. The IRS invites tax professionals and representatives of tax exempt organizations to participate in a Phone Forum on Election Involvement by IRC section 501(c)(3) Organizations (including churches). The seminar provides an overview of the political intervention rules for these organizations.
