The Deceptive Practices and Voter Intimidation Prevention Act of 2007

Unfortunately as we have witnessed during previous elections, many can go to great lengths to intimidate voters, hoping to influence the election in a certain way. Those carrying out deceptive and harassing measures have gone unpunished. Senators Obama and Schumer introduced a bill today that would make such activity a federal crime. WRTL Editorial in LA Times

This LA Times editorial asserts that the Supreme Court should rule that the group Wisconsin Right to Life (WRTL) was deprived of their free speech rights after being prohibited from airing certain ads before the 2004 election. The editorial suggests that Justice Samuel A. Alito Jr. may change the 2003 Supreme Court decision that upheld the ban on electioneering communications ban, giving political speech "breathing room."

IRS Failing to Control Political Speech within Churches?

An op-ed in yesterday's USA Today "Turning a blind eye, IRS enables church politicking" disapproves of the way the IRS is handling a supposedly growing number of churches that do not comply with the ban on endorsing candidates or political parties. The article notes that 40 churches were investigated for activity during the 2004 election season and not one had its tax-exempt status revoked.

Explanation of Policy on 527s

The Federal Elections Commission (FEC) was reportedly still working last week on a document that explains its position on the way it handles complaints against 527 groups. Lawyers for the FEC are scheduled to go in front of a judge tomorrow to do just that, describe how the agency plans to handle 527 groups in the 2008 campaign. Representatives Shays and Meehan filed a lawsuit against the FEC that sought stronger regulation of these groups.

Genuine Lobbying? Connecting Grassroots Lobbying Disclosure and Wisconsin Right to Life Court Challenge

An article in the National Journal ($$), "A Two-Front War Over Lobbying", makes the very interesting point that lobbyists are pleased in light of grassroots lobbying disclosure falling from the Senate ethics and lobbying reform bill. The article pairs the loss of grassroots lobbying disclosure and the Supreme Court's decision to take up the Wisconsin Right to Life (WRTL) case as both key victories for lobbyists. Thematically the two issues concentrate on the regulation of political speech and advocacy.

Support for Grassroots Lobbying Disclosure

This Roll Call ($$) opinion piece explains why some lobbyists are pleased that grassroots lobbying disclosure is absent from the Senate bill. Grassroots lobbying actually weakens the link between lobbyist and lawmakers. "Requiring grass-roots organizations to register or compelling lobbyists to disclose when they assist groups in contacting fellow citizens would strip consultants of constitutionally guaranteed anonymity and would deprive organizations championing unpopular causes of skilled representation."

CRS Report Says Grassroots Lobbying Disclosure Constitutional

A Jan. 12, 2007 report from the Congressional Research Service (crs) says courts have upheld the constitutionality of disclosure requirements aimed at "preventing corruption and limiting the undue influence of monied and powerful interests..." The report, Grassroots Lobbying: Constitutionality of Disclosure Requirements by CRS legislative attorney Jack Maskell, provides a detailed history of legal protections for grassroots advocacy and the government's interest in disclosure. Unusual Practices in Surveillance Program Lawsuits

Today's New York Times addresses how complicated civil lawsuits are becoming regarding the domestic surveillance program. The Bush administration has employed extraordinary secrecy in defending the National Security Agency’s highly classified domestic surveillance program from civil lawsuits. Plaintiffs and judges’ clerks cannot see its secret filings. Judges have to make appointments to review them and are not allowed to keep copies. Judges have even been instructed to use computers provided by the Justice Department to compose their decisions.

Wisconsin Right To Life Discussion

As previously noted, the Supreme Court will most likely not hear oral arguments in the Wisconsin Right To Life (WRTL) case until April. However, the current commotion over the case is strong, foreshadowing the commentary to follow the court's decision. Two blogs with differing opinion have been going back forth on the other's commentary. As these arguments bounce off of one another, so does the issue of the case, intent and influence of the WRTL advertisements. Why Did McCain Vote Against Grassroots Lobbying Disclosure?

This morning on National Public Radio (NPR), OMB Watch executive director Gary Bass commented on the grassroots lobbying disclosure provision that the Senate voted against last week. The radio clip discussed how "even" Senator John McCain (R-AZ) voted against it, despite sponsoring legislation in the 109th Congress that called for disclosure of grassroots activities by paid lobbyists. Yet he now voted to strip it out of the ethics and lobbying reform bill, and as insinuated on NPR this morning, this was after conservative groups lobbied him.
