FEC Denies Association's Proposal

The National Association of Realtors (NAR) has proposed that state associations send a larger portion of individual contributions to the NAR, in turn lowering the amount of money going to the state political action committee. In exchange, the NAR will give an equal amount of money from its treasury account to the state association. NAR had asked the Federal Elections Commission (FEC) whether this proposal would be permitted. Other similar groups are interested in ways to expand the ability to raise hard money.

Holy Land Foundation

A notable New York Times article covers new action that is being taken to challenge the Treasury Department's process for designating charities as supporters of terrorism. The Treasury Department has designated five U.S. Muslim charities as terrorist supporters seizing millions of dollars in assets, including the largest Holy Land Foundation. On Monday Holy Land sued seeking dismissal of over half of the charges against them. This decision to sue was based on the ruling last month in a Federal District Court in Los Angeles.

New FAQs On Exempt Groups

On December 5, the Internal Revenue Service (IRS) released a new set of frequently asked questions for exempt organizations. The FAQs include answers such as where complaints about the activities/operations of tax-exempt organizations should be sent and whether contributions are deductible while an organization's application for tax exemption is pending. The new FAQs are available here.

New Means to Enforce Church Politics

Attorneys Marcus S. Owens and Natalie E. Fay wrote an article titled, "Penalizing Instigators of Political Campaign Intervention." The authors suggest that in light of increased attention on IRS audits of tax-exempt groups who have engaged in campaign intervention, the IRS should redirect enforcement measures to the candidates who in fact encourage the misuse, particularly of churches. Owens and Fay describe how candidates entice a church's involvement through various examples, such as candidates who have openly included churches in their campaign strategy, leaving the churches vulnerable.

Plans to Probe Privacy Issues

This New York Times article reports that Democratic leaders want to conduct increased oversight of counterterrorism programs, including wiretapping and data-mining programs. Senator Leahy made this opinion clear during a hearing yesterday questioning Robert S. Mueller III, director of the FBI. These investigatory plans are very encouraging.

Senate Electronic Campaign Filing Editorial

This editorial, "Dark Ages Disclosure" appeared in yesterday's Washington Post. "In an age when such reports can be filed with the click of a mouse, Senate candidates submit their disclosures on paper, with weeks of delay before they are transferred to a form available and searchable on the Internet. . . This delay is so obviously unjustified that we expected the legal glitch to be quickly fixed." It speaks of one clear-cut reform that the 109th Congress should pass before recess.

Campaign Finance Reformers Advocate Quick Action

A bipartisan group of campaign finance reformers joined together yesterday at a press conference announcing their commitment to lobbying and ethics reform. BNA Money and Politics reports; "Sens. John McCain (R-Ariz.) and Russ Feingold (D-Wis.) and other lawmakers said at a press conference that they are working together on a strategy that will permit identical bills to be introduced in the House and Senate.

Reform Rumblings

Given that the soon to be Democratic majority will have 10 unapproved spending bills, incoming House Majority Leader Hoyer was questioned on how Democrats will handle the 100-hour legislative agenda. The National Journal (subscription required) reported that Hoyer commentated that the 100 hours of legislating will take place before the continuing resolution expires. "One change in the Democrats' agenda is that the rules changes and ethics reforms promised by Democratic leaders will not be part of the 100-hour slate . . .

Court Says Parts of Executive Order Used to Shut Down Charities are Unconstitutional

A Nov. 27 decision by a federal district court in Los Angeles found that two portions of Executive Order 13224 (EO), used to designate organizations as supporters of terrorism, are unconstitutional. The case was filed by the Humanitarian Law Project (HLP) and other nonprofits that want to provide support for "lawful, nonviolent activities" of the Kurdistan Workers Party (PKK) and Tamil Tigers (LTTE), which have both been designated as terrorist organizations.
