House and Senate Begin Ethics and Lobbying Reform

The House and Senate have recently convened, and as promised, the next two days will involve the adoption of new House rules that address ethics, lobbying, budget enforcement, and the disclosure of earmark sponsors. The text of the House rule changes can be read here. These new House rules include:
  • prohibiting members and staff from accepting gifts or meals from lobbyists or private organizations that have lobbyists.

All Parties Want Supreme Court to review WRTL Case

BNA Money and Politics (subscription required) reports that the Federal Election Commission (FEC) and the congressional sponsors of the Bipartisan Campaign Reform Act (BCRA) have appealed to the U.S. Supreme Court in regards to the federal court ruling in the Wisconsin Right to Life Inc. (WRTL) case. It was ruled that the group had the constitutional right to sponsor three grassroots lobbying advertisements during the 2004 election. WRTL filed a motion asking the Supreme Court to expedite consideration of the FEC's appeal. Both sides want the Supreme Court to review the case quickly.

Violence Against Aid Workers

Reuters reports that aid worker violence reached a high in 2006 with 90 major incidences. Over 40 percent took place in Sudan. The article addresses the need for non-governmental organizations to be recognized as neutral and impartial, regardless of skin color. "It's not just that aid workers are associated with political actors; they are political actors. In conflict situations, attacking them is seen as an effective way of controlling the local population."

Court Decides Grassroots Lobbying Ads Not Barred by Campaign Finance Restrictions

2006 started with a Supreme Court decision that allowed the Wisconsin Right to Life Committee (WRTL) to challenge the constitutionality of the McCain-Feingold rule that barred them from airing grassroots lobbying ads about judicial nominations 60 days before the 2004 election. The case was sent back to a lower court to decide if the facts in WRTL's situation entitled it to an exemption from the ban.

House Lobbying and Ethics Proposals Formally Announced

The House ethics proposals were announced yesterday and incoming House Speaker Nancy Pelosi reaffirmed promises of reform. The proposals included the creation of a panel within the Appropriations Committee that will oversee intelligence agencies and a House task force to consider establishing an outside ethics panel.

Leahy Pledges Oversight of Privacy and Human Rights Issues

As previously reported, the new chairman of the Judiciary Committee Senator Leahy plans to increase oversight of government programs, placing a high priority on privacy issues. BNA Money and Politics (subscription required) reported on Leahy's speech at Georgetown University Law Center. There are also plans to create a Subcommittee on Human Rights and the Law. Leahy was quoted in The New York Times saying, "the White House accelerated its power plays at the expense of the other branches of government — all in the name of fighting terrorism."

Anticipated FEC Fines

Earlier in the week Roll Call (subscription required) reported that the Federal Elections Commissioned (FEC) was likely to fine some 527 groups involved in the 2004 campaign. Yesterday, the FEC fined three 527 groups, Swift Boat Veterans, the League of Conservation Voters and MoveOn.org’s Voter Fund, after determining that the organizations violated requirements to register as political committees. The groups registered with the IRS as 527s which bars them from express advocacy, but the FEC determined that their large donor funds set involvement in campaign activity as their major function.

FEC Denies Association's Proposal

The National Association of Realtors (NAR) has proposed that state associations send a larger portion of individual contributions to the NAR, in turn lowering the amount of money going to the state political action committee. In exchange, the NAR will give an equal amount of money from its treasury account to the state association. NAR had asked the Federal Elections Commission (FEC) whether this proposal would be permitted. Other similar groups are interested in ways to expand the ability to raise hard money.

New FAQs On Exempt Groups

On December 5, the Internal Revenue Service (IRS) released a new set of frequently asked questions for exempt organizations. The FAQs include answers such as where complaints about the activities/operations of tax-exempt organizations should be sent and whether contributions are deductible while an organization's application for tax exemption is pending. The new FAQs are available here.
