IRS Reports on 2006 Political Activities Enforcement Program, Releases Guidance

On June 8, the Internal Revenue Service (IRS) released a report on the initial results of its 2006 program enforcing the ban on partisan electioneering by charities and religious organizations. The same day, it also released Revenue Ruling 2007-41, which provides guidance nonprofits can rely on in planning permissible voter education and mobilization activity. The results of the enforcement program to date show a continued low level of violations.

Summary and Analysis: IRS Revenue Ruling on Charities and Election Activity

On June 1, 2007 the Internal Revenue Service (IRS) released Rev. Rul. 2007-41 which provides guidance to help charities and religious organizations avoid violating the prohibition on partisan intervention for or against candidates in elections. The ruling includes 21 examples and explanations charities and religious organizations can rely on in planning their get out the vote, voter education and mobilization activities. It is helpful step toward providing clearer definitions of allowable and unallowable activities, but does not establish any safe harbors or bright line rules. This summary and analysis highlights the key points the IRS makes about the law and six categories of activities: voter education, registration and participation efforts, activities of individuals, candidate appearances, issue advocacy, renting facilities, mailing lists and other business activities, and web sites.

Environmental Group Founder Guilty of Obstruction of Justice in Abramoff Lobbying Case

Last October, Senate Finance Committee Ranking Member Max Baucus (D-MT) released a report examining interactions between five tax-exempt organizations and lobbyist Jack Abramoff and his associates, finding instances of serious abuse. Next Step for Lobbying and Ethics Bill: House-Senate Conference Committee

BNA Money and Politics ($$) reports that the even though House-Senate conferees have yet to be named, the process is proceeding towards completing a final lobbying and ethics bill. The House Judiciary Committee and the Senate Rules Committee are working on comparing the two bills, focusing on the differences that need to be resolved. There are a few important differences, such as the absence in the House version of a provision to double from one to two years the ban on lobbying by lawmakers.

Initial Findings on 2006 IRS Political Activities Enforcement Efforts Released

The Internal Revenue Service (IRS) published a summary of its 2006 program enforcing the ban on partisan electioneering by charities and religious organizations on June 1, 2007. While only 40 of the 100 cases selected for examination have been closed, the report provides a useful picture of the Political Activities Compliance Initiative (PACI), as well as updated information on the IRS' 2004 enforcement cases. The 2006 report also details a new program that matches state campaign finance reports to the IRS database of 501(c)(3) organizations. On the same day the IRS published guidance in Revenue Ruling 2007-41 on what is considered prohibited intervention in elections. Overall, the results indicate a low level of violations by 501(c)(3) organizations.

IRS Questions Political Activity of Kansas Church

The Wichita Eagle reports that the Internal Revenue Service (IRS) has asked Pastor Mark Holick of Spirit One Christian Center in Wichita Kansas to answer thirty one questions about political activities at the church. The questionable activities include the pastor distributing voter guides and messages on the church's marquee critical of candidates and their position on abortion. Holick has scheduled a news conference today at the church to discuss the issue.
