A Challenge to Restrictions on Legal Services Programs: Dobbins v. Legal Services Corporation

Since 1996, the federal Legal Services Corporation (LSC), which funds legal services for the poor, has placed severe restrictions how its funds can be used, and extended these restrictions to private funds raised by legal services programs. In December 2001 four legal service programs in New York City, a private charity and pro bono attorney filed suit against the Legal Services Corporation challenging the constitutionality of restrictions. On December 20, 2004 the United States District Court for the Eastern District of New York struck down application of the rule imposing the restrictions on private funding of legal aid groups. The judge denied the plaintiffs' challenge to the restrictions on direct LSC funding. The case, which has broad implications for the nonprofit sector, is under appeal.

Study Finds Little Oversight of Religious Content or Client Choice in Gov't-Funded Programs

An Urban Institute study of the Bush administration's Faith Based Initiative, found that, while many faith-based organizations (FBOs) are integral service providers, they often lack established benchmarks and have little oversight at the state, local and federal levels, regarding religious content and the ability of clients to choose an alternative provider.

New Faith-Based STudy by Urban Institute

A new study concludes that Bush administration efforts to expand faith-based contracting via targeted initiatives are changing the nature of social services supported directly with federal funds far more than has legislation passed in the mid-1990s. The study is the first in-depth look at the major block grant programs in the Department of Health and Human Services with legislated Charitable Choice provisions, as well as at discretionary programs funded under the Compassion Capital Fund (CCF).

Bush To Encourage Corporate Giving to Faith-Based Orgs

President Bush said he will hold a White House summit next spring to encourage corporations and foundations to give more money to churches and religious charities. Bush announced the summit as he met behind closed doors with 17 leaders of black churches and community groups -- a traditionally Democratic demographic that Republicans have been trying to persuade to switch alliances.

Senate Seeks to Restore Funding

The US Senate has restored many of the social service funding cuts originally sought by President George W. Bush and the House of Representatives, as legislative work continues on the 11 bills that make up this year's federal budget. The differences in the proposed spending -- which include programs under the Faith-Based and Community Initiative -- will have to be resolved in House-Senate conference committees before being sent to the President for final approval.

Cuts Will Hurt Faith-Based and Community Groups

The annual budget process is well underway, with appropriations committees in the House and Senate making conflicting decisions about funding social service programs. While the Senate Appropriations Committee voted to shift $7 billion from the defense budget to pay for domestic programs, the House is taking the opposite approach. The House subcommtitee on Labor, Health and Human Services, Education and Related Agencies approved buts in 49 programs to save $2.3 billion.
