Alert: Redesigned Form 990 Released

The IRS released for comment and discussion proposed revisions to Form 990 and other supporting information. The IRS hopes to have the form ready for use for the 2008 filing year for returns filed in 2009. The redesign is based on three principles, "enhancing transparency, promoting tax compliance, and minimizing the burden on the filing organization." The comment period will run for 90 days, and comments are due no later than September 14, 2007.

Environmental Group Founder Guilty of Obstruction of Justice in Abramoff Lobbying Case

Last October, Senate Finance Committee Ranking Member Max Baucus (D-MT) released a report examining interactions between five tax-exempt organizations and lobbyist Jack Abramoff and his associates, finding instances of serious abuse. And now most recently, the founder of one of those organizations was charged with tax evasion and obstruction of justice as part of the continuing federal criminal investigation.

Robert Egger, president of D.C. Central Kitchen and a leader of the Nonprofit Congress, has written this must read article from the Chronicle of Philanthropy ($$). Senators Call for Updated Form 990, a Seemingly Opportune Time

Senator Max Baucus (D-MT) has made another noteworthy formal communication to Treasury Secretary Paulson, this time along with ranking Finance Committee member Charles Grassley (R-IA). The leaders of the Senate Finance Committee have urged Treasury to update Form 990, the federal tax form nonprofits file each year to report tax information, so that the financial operations of nonprofits can be better understood. There is a particular focus of concern on scrutinizing hospitals and universities.

Supreme Court Proposes Increased Disclosure of Ties Between Amicus Filers, Parties

On May 17 the Supreme Court proposed several changes in its rules, including procedures for groups or individuals filing friend of the court (amicus curiae) briefs supporting a party in a pending case. Proposed rule 37.6 would impose a new disclosure requirement, expanding the current requirement that amicus filers disclose whether the attorneys for one of the parties in the case helped write the brief and identify outside funders. Possible Technical Changes to PPA Exempt Organization Provisions

The Georgetown University Law Center held a conference titled, "Representing and Managing Tax-Exempt Organizations 2007." BNA Money and Politics ($$) reported on much of its content, including news that Congress may be making technical corrections to some of the provisions of the Pension Protection Act (PPA). IRS Commissioner to Head Reformed Red Cross

Mark Everson, the commissioner of the Internal Revenue Service (IRS), will be the new chief executive of the American Red Cross. As many are aware, while with the IRS Mr. Everson has had a particular focus on government oversight of nonprofit organizations. And in related news, yesterday the House approved by voice vote a bill to reform the national Red Cross, the American National Red Cross Governance Modernization Act of 2007 (H.R.1681).

New Electronic Filing Requirement for Small Tax Exempt Organizations

Since the Pension Protection Act of 2006 (PPA) tax exempt organizations that gross $25,000 or less will be required to annually file electronically Form 990-N, also called the e-Postcard. Starting in 2008, this filing requirement applies to tax periods beginning after December 31, 2006. The Internal Revenue Service (IRS) plans to mail educational letters beginning in July 2007 to the small organizations that may now have to file the e-Postcard. Changes to the 2006 Forms 990 and 990-EZ and Schedule A were discussed in Phone Forums in March. For more information visit the IRS website.

Public Citizen Charges Americans for Job Security as Nonprofit Front

Public Citizen filed a complaint with the Internal Revenue Service (IRS) and the Federal Election Commission (FEC) against Americans for Job Security (AJS) asserting that the organization's primary purpose is to influence elections. Therefore the organization should not be eligible for 501(c) non-profit tax status, and should instead be required to register as a political committee. Public Citizen is requesting the IRS to revoke the group's status as a nonprofit, collect back taxes on undeclared electioneering activities, and pay penalties for violating its tax exempt status.
