House Passes Shays-Meehan Campaign Finance Bill 240-189

A substitute bill sponsored by Reps. Shays and Meehan passed the House of Representatives at 2:40 a.m. this morning by a vote of 240- 189. 198 Democrats and 41 Republicans voted for the bill. During the debate the sponsors entered colloquy language into the record that clarifies the FEC's role in defining exceptions to issue advocacy restictions for broadcasts that are "wholly unrelated to an election." The FEC will need to act within 90 days of the effective date of the law. (The colloquy language is not yet on the GPO website, but the text is included at the end of this alert).

House Bills Would Allow Religious Congregations To Use Funds For Partisan Politics

Just before news of September 11th's tragic events reached Capitol Hill Majority Whip Tom DeLay (R-TX) and Rep. Walter Jones (R-NC) held a news conference to promote HR 2357, the Houses of Worship Political Speech Protection Act. It would allow religious congregations to support or oppose candidates for office without losing their tax exemption or ability to receive deductible contributions, as long as election related efforts do not amount to a substantial portion of their overall activities.

Competing Campaign Finance Bills Headed To House Floor

The House Administration Committee reported out two campaign finance reform bills on June 28, voting 5-3 along party lines. HR 2356, a new version of a bill sponsored by Reps. Christopher Shays (R-CT) and Marty Meehan (D-MA), was reported unfavorably. It closely follows the provisions of McCain-Feingold, which passed the Senate in March.

Christopher Shays (R-CT) and Marty Meehan (D-MA) to strengthen the portion of their bill dealing with exceptions to the ban on broadcast "issue advocacy" during an election cycle. The bill would allow the Federal Election Commission (FEC) to make rules exempting these activities, but does not require the FEC to act.

Nonprofit Amendments to Campaign Finance Reform Bills

Amendments that would protect nonpartisan communications by charities were recently submitted by OMB Watch to Rep. Christopher Shays (R-CT) and Marty Meehan (D-MA), co-sponsors of campaign finance reform legislation in the House of Representatives (HR 380). In separate meetings over the past few weeks both Shays and Meehan expressed general agreement with concerns raised by representatives of 501(c)(3) organizations, but said specific changes would have to be carefully reviewed to ensure that no new loopholes are created.
