Rules for Lobbyists in Transition

New rules on lobbying have been announced for those working on President-elect Barack Obama's transition team. For example, lobbyists can serve in the transition as long as their activities do not involve areas of policy they have tried to influence in the past year. Federal lobbyists will be prohibited from any lobbying while they are at work on the transition. The rules also prohibit people from lobbying the Obama administration for a year on any matters in which they worked while on the transition team.

Obama Transition And Issues of Ethics

The New York Times reports that President-elect Barack Obama "is trying to fulfill campaign promises of sweeping ethics restrictions that could deter some potential appointees." According to Obama's website, political appointees will be prohibited from working on regulations or contracts directly and substantially related to their prior employer for two years. And no political appointee will be able to lobby the executive branch after leaving government service during the remainder of the administration.

Groups Release Agenda to Overhaul the Presidential Public Financing System Along with New Ethics and Lobbying Reforms

Bill Improving Inspectors General Independence Passes Congress

Congress recently passed legislation that reforms the functions of federal agencies' inspectors general to increase their independence and insulate them from political interference. The passage comes after more than a year of negotiations in Congress and between the legislative and executive branches. President Bush is expected sign the bill.

New GAO Report on Lobbyist Compliance with Disclosure Reporting

According to a report released Sept. 30 by the Government Accountability Office (GAO), "lobbyists could provide accurate supporting information—in either written or verbal form—on income or expenses for at least 95 percent of all first quarter reports filed that required this information." This was based on a random sampling of 100 clients chosen from the first-quarter reports. The report, Observations on Lobbyists' Compliance with New Disclosure Requirements," was required by the Honest Leadership and Open Government Act.

FEC Holds Hearing on Bundling Rule

The Federal Election Commission (FEC) held a hearing on how to implement a new requirement that all federal candidates, parties and political committees report any registered lobbyists or lobbying entities who engage in bundling of campaign contributions. The Honest Leadership and Open Government Act required the FEC to create a rule for the disclosure of bundled lobbyist contributions worth $15,000 or more.

Oral Argument in NAM Lobbying Disclosure Case

On September 12, 2008, the D.C. Circuit Court of Appeals heard oral argument in National Association of Manufacturers (NAM) v. Taylor. NAM is challenging a provision (Section 207) in the Honest Leadership and Open Government Act (HLOGA) that requires a lobbying coalition to disclose members that fund and actively participate in the coalition's lobbying efforts. NAM's argues that the HLOGA provision violates the First Amendment and is unconstitutionally vague.

FEC to Vote on Proposed Bundling Rule

The Federal Election Commission (FEC) will hold a public hearing Sept. 17 on proposed bundling rules for reporting contributions bundled by lobbyists, lobbying organizations, and the political action committees of lobbyists. The FEC will hear from some of those who commented in writing on the proposed rule issued Nov. 2007.

Convention Parties Unaltered by Ethics Rules?

Press coverage of the Democratic National Convention spotlights the convention parties in light of the new lobbying and ethics law, and it will likely be the same during the Republican convention. Many are quick to criticize and declare that in regards to the conventions, the new ethics rules were a failed attempt to weaken the connection between lawmakers and lobbyists, and were merely superficial changes.
