NIH Receives Data Quality Challenge on Chemical Information

The Chemical Products Corporation (CPC) submitted a data quality petition to the National Institutes of Health (NIH) within the Department of Health and Human Services November 15, 2002, challenging a draft technical report on the toxicology and carcinogenesis of Anthraquinone. CPC previously submitted a challenge to the Environmental Protection Agency regarding barium under the Data Quality Act. CPC manufactures anthraquinone for use by the paper industry as an intermediate chemical in the production of dyes and other organics. Request for Correction

The Department of Commerce U.S. Patent and Trademark Office (USPTO) received a data quality request October 2, 2002 requesting correction of information associated with a specific patent (6,344,272). The petitioner asserts that while the patent was processing, the wrong set of claims where identified and disseminated with the patent on the USPTO website.

Data Quality Lawsuit Filed Against the Department of Education

The College Sports Council (CSC) contends a report issued by the Secretary’s Commission on Opportunity in Athletics violates the data quality guidelines, according to a lawsuit filed against the Department of Education. CSC claims that the report is statistically flawed and does not meet the requirement for pre-dissemination review. The lawsuit names Secretary of Education Roderick Paige and the Department of Education’s (ED) Chief Information Office William Leidinger as defendants in the case.

The Environmental Working Group (EWG) submitted a data quality challenge to the Food and Drug Administration (FDA) within the Department of Health and Human Services (HHS) on December 22, 2003, one of the few challenges submitted by a nonprofit. EPA Receives Another Perchlorate Data Quality Challenge

The Perchlorate Study Group (PSG) submitted a data quality request for correction to the Environmental Protection Agency (EPA) December 3, 2003, challenging a number of documents used to assess implications of perchlorate ingestion. This is the third challenge EPA received on perchlorate. Perchlorate is a chemical found in rocket fuel and has contaminated drinking water near Department of Defense (DoD) sites in at least 22 states. Request for Reconsideration

Pressure Continues to Mount Against OMB's Peer Review Plan

Many recent news stories and editorial pieces from around the country are critical of the Office of Management and Budget’s (OMB) draft bulletin on peer review, thereby maintaining pressure on the agency to either drastically alter the policy proposal or withdraw it entirely. OMB’s Data Quality Guidelines, the information policies that the peer review bulletin builds upon, received little media criticism or even attention during development. However, the peer review bulletin seems to be garnering much more interest, in part because so many scientists are rejecting this “scientific” policy.

Another Lawsuit Filed Under the Data Quality Act

The Public Employees for Environmental Responsibility (PEER) filed a lawsuit Dec. 9 against the Army Corp of Engineers alleging the Corp released a status report that violates the Data Quality Act. The Corp failed to respond to a request for correction under the Department of Defense’s data quality guidelines filed by PEER on Aug. 20.

OMB Watch Submits Comments on Peer Review Today

OMB Watch filed comments with Office of Management and Budget (OMB) today on its draft bulletin for peer review. Public interests groups, academics, and regulators were all concerned with the bulletin because it could severely hamper agencies by creating burdensome peer review requirements that are too vulnerable to industry manipulation. Most federal agencies currently have peer review guidelines that function well. While the deadline for public comments ends today, federal agencies may continue to submit comments on the draft bulletin until Jan. 15.
