New CAP Papers Offer Contracting Reform Recommendations

The Center for American Progress (CAP) has released a series of three new papers on how the federal government can improve contracting through selective insourcing, better auditing, and increased transparency. Each paper contains specific recommendations that would help improve how Uncle Sam doles out contracting dollars and the return Americans could see on that spending.

In a thoroughly confused editorial published last weekend, the Washington Post told readers it simply does not care for President Obama’s draft executive order (EO) on contractor disclosure, claiming it’s “uneasy” with the “well-intentioned but flawed” proposal. Coming to the Post’s rescue, though, congressional Republicans have introduced stand-alone legislation similar to the recently passed Cole amendment that would prevent federal agencies from requiring contractors to disclose political spending to the public.

On April 15, the government finally made the Federal Awardee Performance and Integrity Information System (FAPIIS) available to the public. Reviews of the previously secret database have been harsh – Tom Lee at the Sunlight Foundation said, "FAPIIS may be the worst government website [I've] ever seen" – and after perusing the site last week, this blogger sees no reason to question that assessment.

Withdrawing a proposal made last May, the administration quietly announced yesterday that it's abandoning what has turned out to be a tepid examination of posting federal contracts online.

Last week in the Los Angeles Times, Berkeley Law School Dean Christopher Edley wrote a compelling op-ed on why President Obama should end the delay and sign an executive order enforcing a new "high road" contracting policy for the federal government. While it's not likely to have the same instant stimulative effects of the Recovery Act, a "high road" contracting policy could, as Edley argues, "do more for the economy than [a] second stimulus measure."

The Federal Times had an interesting piece last week on the contracting industry's reaction to a recent notice in the Federal Register seeking input on "how best to amend the Federal Acquisition Regulation (FAR) to enable public posting of contract actions." Despite the FAR Councils' stated efforts to post contracts "without compromising contractors' proprietary and confidential commercial or financial information," industry executives are beside themselves over such a monumental change. Not surprisingly, their arguments against the idea don't hold much water.

Yesterday afternoon, Sen. Russ Feingold (D-WI) introduced bi-partisan contracting reform legislation, titled the "Federal Contracting Oversight and Reform Act of 2010," that seeks to bring more transparency to the government contracting process. Although several of the bill's provisions could have been stronger, one hopes the legislation, if enacted, will lay the foundation for future reforms.
